TERMS OF SERVICE
OSINT Copilot for Obsidian

1. INTRODUCTION

These Terms of Service ("Terms") govern your use of the OSINT Copilot plugin for Obsidian ("Plugin") and the associated API services ("API Services") provided by Probe Point Analytics SRL ("Company," "we," "us," or "our"), a company registered in the Republic of Moldova.

By installing, accessing, or using the Plugin or API Services, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Plugin or API Services.

2. DEFINITIONS

  • "OSINT Copilot" or "Plugin": The open-source Obsidian plugin that provides AI-powered features for threat intelligence research, entity relationship mapping, and report generation.

  • "API Services": The proprietary, closed-source backend services that enable premium features of the Plugin, including AI chat, knowledge graph building, automated report generation, and entity relationship inference.

  • "Free Features": Core Plugin functionality that does not require an API key.

  • "Premium Features": Advanced functionality requiring an active subscription and API key.

  • "Vault": Your Obsidian knowledge base stored on your device.

  • "User Data": Information and content you provide or generate through use of the Plugin and API Services.

3. LICENSE GRANTS

3.1 Plugin License (Open Source)

The Plugin is released under an open-source license specified in its public repository. You may use, modify, and redistribute the Plugin according to the terms of that license.

3.2 API Services License (Proprietary)

The API Services are proprietary. Subject to payment of applicable fees and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the API Services solely in connection with the Plugin.

You may not:

  • Reverse engineer, decompile, or attempt to derive API source code

  • Use the API to create a competing service

  • Sell, sublicense, share, or redistribute API access

  • Use the API Services for unlawful, harmful, or prohibited purposes

4. ACCOUNT AND API KEYS

4.1 API Key Requirement

Premium Features require a valid API key. You are responsible for:

  • Keeping your API key confidential

  • All usage under your key

  • Immediately notifying us of unauthorized use

4.2 API Key Revocation

We may suspend or revoke your API key if:

  • You violate these Terms

  • Payment fails or subscription lapses

  • We detect abuse, suspicious activity, or system risk

5. FEES AND PAYMENT

5.1 Pricing

Pricing for Premium Features is listed on our website or through authorized channels.

5.2 Payment Terms

  • Subscription fees are billed in advance

  • All payments are non-refundable unless required by law

  • We may adjust pricing with 30 days’ notice to active subscribers

  • Non-payment may result in immediate service suspension

5.3 Free Tier

A free usage tier may be offered. It may be limited or discontinued at any time.

6. DATA HANDLING AND PRIVACY

6.1 Data Processed

When Premium Features are used, the following may be processed:

  • Selected Vault excerpts required to fulfill requests

  • Queries, prompts, and output instructions

  • Usage and performance metrics

6.2 Storage

  • Your full Vault remains stored locally; we do not upload your Vault.

  • Generated reports are stored temporarily in secure cloud storage (e.g., AWS S3).

  • API keys remain stored locally in your Obsidian configuration.

6.3 Security

We employ:

  • HTTPS/TLS encryption

  • Secured cloud infrastructure

  • Access controls and monitoring

6.4 Retention

  • Request data is transient and deleted after processing

  • Generated reports are retained for up to 90 days

  • Usage logs retained for up to 12 months

6.5 Third-Party Services

We may process data using third-party AI model providers and cloud hosting vendors. Their processing is subject to their respective privacy policies.

7. ACCEPTABLE USE POLICY

You agree not to use the Plugin or API Services to:

  • Violate applicable law

  • Conduct unauthorized surveillance or intelligence gathering

  • Target individuals, journalists, activists, or vulnerable persons

  • Support criminal activity, disinformation operations, or hostile state intelligence work

We may suspend or terminate access for violations.

8. INTELLECTUAL PROPERTY

All rights not explicitly granted are reserved by Probe Point Analytics SRL.
The "OSINT Copilot" name, branding, models, and backend systems remain our exclusive property.

9. WARRANTY DISCLAIMER

The Plugin and API Services are provided “AS IS” without warranties of any kind.
We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.

  • Our total liability is limited to the fees you paid in the preceding 3 months.

11. TERMINATION

You may stop using the Plugin or API Services at any time.
We may terminate or restrict access if you breach these Terms or if continued access creates operational or legal risk.

Upon termination, your API key will be disabled.

12. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Republic of Moldova.
Disputes shall be resolved exclusively by the competent courts of Chișinău, Moldova.
